Article 4 — AI Literacy

Providers and deployers of AI systems must take measures to ensure a sufficient level of AI literacy among staff and others operating AI systems on their behalf, considering technical knowledge, experience, education, and the context the systems are used in. Live since 2 February 2025.

Article 5 — Prohibited practices

Manipulative techniques, exploitation of vulnerabilities, social scoring, untargeted facial scraping, emotion recognition at work or school, and most real-time biometric ID in public spaces. Banned outright since 2 February 2025.

2 August 2026 — Annex III high-risk + Article 50

The general application date. Annex III high-risk AI systems (HR, biometrics, credit, education, critical infrastructure, law enforcement) must comply by this date. Article 50 transparency duties (chatbots, generative content, deep fakes, public-interest text) apply. Article 101 Commission fines on GPAI providers also activate. Any company touching AI systems should have evidence of training and an AI register on file by then. (GPAI Chapter V obligations themselves have applied since 2 August 2025; Article 99 penalty framework also live since 2 August 2025.)

Penalties

Up to €35M or 7% of global turnover (whichever is higher) for prohibited-practice breaches under Article 5. Up to €15M or 3% for breach of operator obligations under Articles 16, 22, 23, 24, 26, 31, 33, 34 and 50 (Article 99(4)). Up to €7.5M or 1% for supplying incorrect, incomplete or misleading information to authorities (Article 99(5)). Article 4 has no harmonised fine tier in Article 99; enforcement runs through national residual measures under Article 99(1).

The law doesn't require a university

The EU AI Act does not mandate a specific accrediting body for Article 4 literacy. What it requires is that staff demonstrably have a sufficient level of literacy proportionate to risk. A reputable provider issuing a verifiable certificate against a documented curriculum satisfies that test.

Is the certificate "official"?

The EU AI Act doesn't designate official issuers for Article 4. What matters in an audit is: documented curriculum, evidence each person completed it, and a credible issuer. Agentive provides all three. Many of our clients pair our cert with their internal HR record.

How long does the whole thing take?

Typical client: 4–6 weeks end to end. Kick-off workshop in week 1, online modules over weeks 2–4, evidence pack and cert issued in week 5. Rush options compress to 2 weeks.
